I think this is what is happening in your cases,
If you efile for your AP and If your last fingerprinting was done 18 months before Then you will get Fingerprinting notice and you got to go n give new finger prints.
If you paper file, Whether or not your FP expired (18 months) you will never get finger printing notice. (unless your PD is current and they are adjudicating your case and sending a RFE).
Always better to paper file.
So to confirm if what you are thinking is true or not I called USCIS,
The guy in TSC said it is a mistake and they will clarify it. I wasn't very convinced with his response, I called back after sometime, this time since there was no response to TSC it was route to other service center

After several identification questions, Officer said this is not related to finger prints and she was not sure if it is related to I-485 interview either as they put reschedule interview note on my I-131 application.
Finally she gave me a WTC-XXXXXXXX-TSC number, asked for my cell # and asked me to call back after 10 days if I don’t hear anything from the USCIS.
I really don’t know what is happening; I don’t have much choice either other than waiting for something “GOOD “ to happen

He needs to find a consultant who can sponsor a H1B for him. But H1B for this fiscal year is over he might have to wait for the fiscal year of 2008

hi All,

I got my GC last month. My company has some problem and requested to take pay cut (50%) for next 3 months. Will this effect my Green Card. I came to know that I should get the salary mentioned in the file at-least for next 6 month after getting the GC. Is this true?
Please help me, I have to take decision ASAP.

1. Salary cut should not cause any problem for you or your employer. It would be ideal if your employer also provides some reason (like slow economy!) for it on a letter.
2. And of course you can leave the employer on that grounds. This will not affect your GC in any way.
So relax....what all matters is "a good faith intention" at the time GC was approved. It is not your fault that the company is in financial trouble. You can switch employers or work with same employer at lower salary; all of it fair.

if u change ur job using H1 transfer..so does it mean ...he has to restart his GC all over again?? ok i am little confused here..

I believe AC21 is for shifting employers on EAD after 180 days of I-485.

The officer you met did not know the difference between AP applied on humanitarian grounds and AP applied based on pending I-485.
My wife entered NEWARK after 6 months in India ( using I-485 based AP) and no questions were asked although the waiting time inside the secondary inspection room was really long.

more questions:
1- if I apply for extension before the I-96 expiry date and it will get deny after the 180 days of my I-94 expiry and before the 240 days, can I stay to file a new petition which will be on the next April? will I be out of status?
2- during this time ( after applying and before getting the result) can I apply for H1-B transfer?
3- Do I have to go back to my home country if it is approved to get the new I-94?
6- Does anybody know where should I ask for duplication as I dont have the originals?

Thank you for contacting me regarding the immigration debate in the
U.S. Senate. It was good to hear from you.
As you know, in the 109th Congress, the Senate considered changes to
immigration law. These efforts would affect more than just undocumented
workers here in the United States � it would affect every American in
one way or another.
I supported the bipartisan Comprehensive Immigration Reform Act of
2006, S. 2611, when it was considered in the Senate during the 109th
Congress. This bill would have provided many new provisions for border
security and enforcement and to address legal and illegal immigration. The
legislation would have provided funding to reinforce hundreds of miles
of existing border fences and establish a �virtual fence� comprised
of cameras, sensors, automated aerial surveillance tools, and other
security measures. The bill would also have authorized funding for
additional Customs and Border Patrol agents to assist with security efforts,
and required employers to have a system to verify the required
documentation from potential workers. S. 2611 would have increased the number
of visas for high-skilled workers, including those who have earned an
advanced degree. Finally, the bill would not have allowed for amnesty,
but it would have provided a meaningful way to address the legal status
of undocumented workers who currently live in our country.
Under the Senate proposal, undocumented workers could have earned legal
status after completing all the requirements to begin to adjust their
legal status. These requirements include filing an application, payment
of all fines, fees, and back federal income taxes, and providing proof
of being physically present in the United States and being employed for
five years prior to the bill�s enactment. Undocumented workers must
then continue to show proof of employment and being present for at
least six years after the bill would have gone into effect. Individuals
must also demonstrate basic citizenship skills, pass security and law
enforcement requirements, and complete Selective Service registration
requirements.
As you may know, the comprehensive immigration bill passed the Senate
on a bipartisan vote with the support of the White House. The House of
Representatives passed another version of immigration reform that
emphasized enforcement only. Instead of meeting in conference to negotiate
differences in the respective bills, the House held a series of public
hearings around the country, and refused to meet with Senate
negotiators, and the 109th Congress ended without this issue being addressed.
I believe that we need a comprehensive approach to immigration reform.
Enforcement is important, and securing our borders is important. But
if we focus only on enforcement and border security, then we will only
have addressed part of the problem. Many of the current proposals are
unworkable and would ultimately cause more harm to our economy and our
country. Our immigration policy should also provide positive change for
the future of our country. We should make sure our actions reflect our
security, our economy, and the opportunity that America has offered for
generations of immigrants.
As we move forward to the 110th Congress, please know that I will keep

Hello All
I have a question concerning my EAD.Company A applied for my H-1B After an year I have trfd my H-1 to company B and I have been working with company B for the past 2yrs 10 months.My H-1 b is due to expire in feb 2009.Company B Applied for my green card also. I-140 approved in November 2007.I got EAD in oct 2007 and has a valid EAD up to aug 2010.technically I am on EAD since I entered the country on advance parole.Now my company is going to renew my H-1 B .In light of the bill that has been passed which doesnot allow forfresh H-1 B as well as H-1 B renewals,what happens to my EAD if my H-1 renewal petetion gets denied?Does denial of non immigrant petetion leads to denial of immigrant visa (i.e pending adjustment of status).What happens to my EAD.I am worried a lot.Pls advice?Should I request my company to stop the renewal process so that I can stay on EAD only.

--Its doesnt mean that you are technically on EAD just for the reason of you entered on AP. You could choose to working on H1-B if you want to (by not sending your I-9)

Chill out and stop worrying. Talk to your attorney and make wise decision that is good for you.

USCIS has clearly mentioned that UI benefits are not considered a public charge.
There are several threads in IV also on this topic.
eb3retro clearly mentioned that he/she is not interested in the 'debate of whether UB can be claimed while in AOS state', but still many without even checking anything anywhere just going on doubting, worrying, suggesting nonsense, etc.
[even though eb3retro knows that getting ui benefits is not a problem for gc application, it is surprising that s/he doesn't know where to find better information on ui benefits! atleast IV is not the best place to look for it! when people lose their job, are they not supposed to get these information by mail from the employer? atleast that is the law in most states.]
Anyway many people ask even things like what is the fee for this/that application, etc? And people even argue on that when anybody can get these information very clearly from USCIS website. It looks like many people don't even read basic instructions.

I attended the event at UMass Lowell. Congressman Marty Meehan and new governor elect Deval Patrick were at the event. The topic of discussion was "global warming". Both governor and congressman took off after the event but I had a chance to talk to their staff.
One of congressman's staff went through the folder I provided with IV documents but he works for energy related issues and will pass to the staff dealing with immigration. He did provide me the senior staff member who looks into immigration issues. I'm going to email and try and meet him. Congressman Meehan is part of the judiciary committee related to immigration.
